Remember the DREAM Act that you and I fought so hard against last year, that would have given AMNESTY to millions of illegal aliens? It's BACK -- and Barack Obama Congress has just BYPASSED Congress to get it through this time!
After all of YOUR hard work, making sure that Obama's "comprehensive immigration reform" AMNESTY and the DREAM Act never passed in Congress... the Obama regime is angry.
So, Obama's cronies hatched a PLOT to do an "end run" around Congress and using their "discretionary executive branch authority" to "legalize" illegal immigrants. And on August 18th, they put their plot into ACTION... in VIOLATION OF THE LAW!
Thankfully Rep. Lamar Smith (R-TX) and Sen. David Vitter (R-LA) have introduced the "HALT Act," so we DO have a way to STOP them -- if we ACT FAST!
As Rep. Smith has described it, this plot was first revealed last year through the leak of a draft memo to the director of the Department of Homeland Security's U.S. Citizenship and Immigration Services (USCIS). The memo, written by top political and career agency officials, suggested that the agency take steps to legalize millions of illegal immigrants. Just to give two examples from the memo:
- DHS can currently grant "deferred action" -- and consequently authorization to legally work in the U.S. -- to removable illegal aliens. The memo says that DHS can "grant deferred action to an unrestricted number of unlawfully present individuals" (ILLEGAL ALIENS), and suggests that it grant deferred action to illegal immigrants "who would be eligible for relief under the DREAM Act" (which YOU defeated already) OR those who have lived in the U.S. since some arbitrary date that they set. Such a move could potentially legalize MILLIONS of illegal immigrants... WITHOUT a vote of Congress!
- Congress has granted the Administration the power to parole aliens into the U.S.
 "on a case-by-case basis for urgent humanitarian reasons or significant public benefit." The memo suggests that parole be used to legalize illegal immigrants "who entered the U.S. as minors without inspection" or who have "lived for many years in the U.S." Such a move could potentially legalize MILLIONS of illegal immigrants...WITHOUT a vote of Congress!
USCIS claims that it has rejected some of the suggestions in the draft memo. But, more recently, a seemingly-authentic draft DHS memo was leaked that repeated them. This memo proposed granting deferred action to "the entire potential legalization population" -- and if that is not possible, then to DREAM Act-eligible aliens or to illegal immigrants who CLAIM to have worked in agriculture.
Well, now we're seeing where this is all headed... because the Obama regime's newly-announced rules regarding illegal immigrants is already being touted as benefiting OVER 300,000 ILLEGALS!
In addition, the second memo proposed to misuse the parole power to allow the sudden influx of over THREE MILLION ILLEGAL ALIENS on extended family green card waiting lists -- dramatically increasing chain migration at a time when millions of Americans are out of work.

IT DOESN'T STOP THERE! To top it off, the new DHS memo outlined the blatant political scheming behind this new administrative AMNESTY effort -- "Done right, a combination of benefit and enforcement-related administrative measures could provide the Administration with a clear-cut political win."
That's what it boils down to for Barack Hussein Obama: a POLITICAL WIN. Not the security and prosperity of America. It's all about the political win for him.
Then, in June, John Morton, the Director of U.S. Immigration and Customs Enforcement (ICE) -- the agency that is supposed to remove illegal and criminal immigrants -- followed through on the threat. He issued a memo to the field, telling agency officials HOW to exercise "prosecutorial discretion" such as by granting deferred action, "deciding whom to stop, question, or arrest," deciding "whom to detain," and "dismissing" a removal proceeding.
Morton's memo made clear that possibly MILLIONS of deportable illegal and criminal immigrants would be potentially eligible for "administrative" AMNESTY. "When weighing whether an exercise of prosecutorial discretion may be warranted for a given alien, ICE officers, agents and attorneys should consider all relevant factors," write Morton... and what are some of those "relevant factors"? GET THIS:
- ICE's "immigration enforcement priorities." (ICE has expressed little interest in deporting illegal immigrants who have not yet been convicted of "serious" crimes.)
- The person's "pursuit of education in the United States". (The Migration Policy Institute estimates that more than TWO MILLION illegal immigrants would be eligible for the DREAM Act amnesty).
- "Whether the person has a U.S. citizen or permanent resident spouse, child or parent... "Whether the person or the person's spouse is pregnant..." (The Pew Hispanic Center estimates that illegal immigrants have 4.5 million U.S.-born and thus U.S. citizen children.)
- The person's length of presence in the U.S. (The Pew Hispanic Center has estimated that millions of illegal immigrants have been in the U.S. since the 1990s.)
Don't get me wrong -- "prosecutorial discretion" has very justifiable uses when exercised responsibly. However, the Obama regime has made it VERY clear that it plans not to use but to abuse these powers. THEY MUST BE STOPPED NOW!
THIS is the reason the "HALT (Hinder the Administration's Legalization Temptation) Act" was introduced by Rep. Smith and Sen. Vitter! The major parts of the legislation will PREVENT the Obama regime from doing ANY of the following:
- STOP Obama from granting parole (except in narrow circumstances),
- STOP Obama from issuing deferred action (except in narrow circumstances),
- STOP Obama from issuing extended voluntary departure to removable aliens,
- STOP Obama from granting work authorization to aliens on a discretionary basis,
- STOP Obama from granting "Temporary Protected Status" (TPS) to any new groups of aliens,
- STOP Obama from waiving the three and 10 year bars to admittance for aliens who have been illegally present in the U.S., and
- STOP Obama from granting cancellation of removal to illegal immigrants.
Like I said, many of these have justifiable uses when exercised responsibly -- which the Obama regime has proven it WON'T do. Therefore, the bill will restore these powers to the next president whom the American people elect -- on January 22, 2013. Because of the Obama Administration's record, it cannot be trusted with these powers!
So how do we handle extraordinary humanitarian situations that might arise in the meantime? Simple: Congress can always act by passing private bills to help individual aliens in the U.S. or outside the U.S. when it's actually wise, just and prudent. Exceptions are easy -- making the Obama regime do the right thing is NOT easy!
So let's make sure this bill PASSES -- to MAKE Obama BACK DOWN on his plan to FORCE THROUGH giving AMNESTY to MILLIONS OF ILLEGAL ALIENS!

Sen. Vitter recently stated, "The Obama administration has taken steps to pass their AMNESTY agenda through executive order and completely bypass Congress. In the Senate we've already rejected some attempts at granting amnesty for illegal aliens by defeating the DREAM Act in last year's lame duck session. The administration has now taken their amnesty push to new levels by attempting to give DHS officials and other agencies the ability to grant amnesty, which is exactly why we're introducing the HALT Act. Awarding AMNESTY over the objections of Congress and the American people would be a slap in the face to taxpayers, and especially to LEGAL immigrants."
And as Rep. Smith wrote recently in The Hill magazine, "What really needs to be stopped is the Obama administration's attempt to implement a backdoor amnesty. Although Congress has defeated amnesty for illegal immigrants several times in recent years, this has not stopped President Obama and his administration from abusing executive branch authority to allow illegal immigrants to remain in the United States."
